What is the current legislation in force regarding scented candles? In the luxury fragrance sector, particularly for high-end scented product manufacturing, there are no EU regulations for the home fragrance industry, which includes luxury scented candles. However, products must comply with labeling requirements and reporting obligations concerning toxicovigilance.
First and foremost, there are three statutory declarations to be made beforehand for luxury fragrance suppliers and private label candle manufacturers:
The SDS (Safety Data Sheet)
This is the essential tool for chemical risk management. The REACH regulation requires you to provide an SDS if you use hazardous substances or formulations in your custom candle production. It includes, for example, the identification of the substance, possible hazards (ecological, toxicological), information on the substances, first aid, etc. It is to be completed by the laboratory.
The UFI (Unique Formula Identifier)
From 2025, the UFI must appear on the label of all products containing hazardous formulations. This allows a quick response in case of emergency, which is crucial for manufacturers of custom branded candles and private label candles.
Déclaration-Synapse (for France only)
The Déclaration-Synapse is a common tool used by the French National Research and Safety Institute (INRS) and Poison Control and ToxicoVigilance Centre (CAPTV). This allows for the secure registration of products, including high-end scented candles, in a single location. The company responsible for putting the product on the market (the company mentioned on the label) must submit this declaration.
Below you will find the mandatory information required when labeling your scented candles, both on the bottom of your container and on your packaging. This is essential for effective signature scent development and ensuring compliance with regulations for luxury scented candles.
